How is UAE end of service gratuity calculated? +
Under UAE Federal Decree-Law No. 33 of 2021, gratuity is calculated based on the employee's basic salary and length of service. For the first five years of service, the employee earns 21 days of basic salary per year. For each year beyond five years, the employee earns 30 days of basic salary per year. The total gratuity is capped at two years of basic salary. The calculation uses the last basic salary at the time of departure, not the average salary over the service period.
Does an employee who resigns get full gratuity? +
Under the current UAE labour law, employees who resign are entitled to full gratuity regardless of their length of service. There is no longer a reduction for resignation as there was under the old labour law. Both resigned and terminated employees are entitled to their full calculated gratuity entitlement, subject to the two year maximum cap.
Is an employee entitled to gratuity if they have served less than one year? +
No. Under UAE labour law, an employee must complete at least one full year of continuous service to be entitled to end of service gratuity. Employees who leave before completing one year are not entitled to any gratuity payment.
